General
„THANKYOO“ is a web platform of the id consulting gmbh in Schalchen, from here on referred to as „id“.Id provides a service exclusively on the basis of these business terms and conditions.Side agreements, reservations, modifications or additions to their validity must be in writing; this also applies to deviations from the written requirement. Conflicts or deviations from these Terms of the contractual conditions are only recognized to be valid if they are written by id ' and explicitly recognized. The user can call up these Terms at any time, even after the finalised contract under, under the "THANKYOO" available link "Terms and conditions”“, print and download and store.
2. Contract Formation
The contractual relationship between id 'and the user comes through the registration by the user for one of the services of id' and by the subsequent activation of the user by id 'agreement. Since id begins the THANKYOO services immediately after the contract begins, there is no right of withdrawal for consumers.
3. Object of agreement
Object of agreement in the contract are the subject of id 'in the context of the Web platform "THANKYOO" offered services.Id 'offers registered users three variants for use of THANKYOO to: a) a free membership “FREE MEMBERSHIP” b) a consideration membership for the private sector "LIFE MEMBERSHIP” c) a consideration membership in the area of professional life," WORK -LIFE MEMBERSHIP " The exact scope of id 'deliverables stems from the currently valid service descriptions of the services offered on the site, which forms an integral part of this contract. Those prices are binding.The user acknowledges that THANKYOO is constantly evolving and may need to accept minor changes to services. The user acknowledges that a 100% availability of THANKYOO not technically feasible, and accepts the temporary disruption of operations or a temporary cessation of THANKYOO for purposes of maintenance or troubleshooting.
4. Costs
The charges for LIFE and WORK-LIFE membership are due for immediate payment with invoicing for the entire duration. The user can use the offered debit procedures, especially the accepted credit cards, or the facilities offered for online payment procedures to honour debts.If a fee cannot be brought in, the user carries all the resulting costs, particularly bank charges in connection with the return of direct debits and similar fees to the extent they represent the costs of triggering event. Id 'can provide users the bills on the charges of membership via e-mail.
5. User Data
The user is obliged, when registering, to use his real data truthfully and completely. The user may not use pseudonyms or an artistic name. Each user can therefore only have one user account. If the data changes later for some reason, the data must be instantly updated. Users with incorrect information or fantasy figures are invariably and without any costs reimbursement locked out. When registering the user chooses a password. The user is obliged to keep this password secret. id will not convey this password to any third party or at any time ask the user for the password.Each user is liable for any damages arising from incorrect information. id is excluded from the responsibility for the accuracy of the information of other users, because id' technically cannot determine whether a registered THANKYOO is user actually is the person the user pretends to be. Each user has therefore the responsibility to determine the accuracy of the identity of another user. Which data of a user are published on the Web, each user has the responsibility of configuring in his profile. id 'uses the personal information of the user exclusively within the framework of THANKYOO. A transfer of data to third parties, except to authorized agencies under a legal obligation or under a court order, as well as in the case of alleged infringement by the users of those whose rights claim to be violated is obviously excluded.
6. Code of conduct
The user agrees to the applicable laws, all rights of third parties and to use THANKYOO only in the context of id 'provided opportunities. Any other use of THANKYOO offered services and content requires the prior written consent of THANKYOO. The tone of speech to other users has to be polite and respectful. Behind every electronic contact is a real human being with feelings, the others wishes are not to be violated. Wishes of other users, for example after termination or limitation of contact attempts must be respected. It is prohibited for the user to employ own mechanisms, software or scripts in conjunction with THANKYOO, which are not made available by id 'or software interfaces, or other acts, which are capable to disrupting or unduly burdening the functionality of the THANKYOO infrastructure. VIDYOOS and TRAINYOOS are copyright of id 'and may not downloaded, copied, modified, reproduced or publicly played. The user who is in breach of these rules of conduct keeps id harmless and without complaint. If a user or a third party through the agency of another user is offended or otherwise violated in his rights, may give a complaint to id. id' is in this case entitled to either own actions, such as a banning, the Deletion of content or the temporary or full lock a user or to give the data the user to those whose rights are believed to be violated in order to avoid a claim or liability of id for others behaviour.
7. Liability
id´ is liable under the law only for damages resulting from intentional or gross negligence. The liability for minor negligence is excluded. The injured party has the responsibility to prove the existence of malice or gross negligence. id 'assumes no responsibility for sent or created content by the users of THANKYOO.
8. Alteration of contract
id 'reserves the right to change these Terms at any time without giving reasons for the change, unless it is not reasonable for the user. id ' is to give due notice to the user of changes of the GTC. If the user does not contradict the application of the new GTC within two weeks after the notification, the revised terms are accepted by the user.
9. Termination of the contract, refund of prepaid charges
The FREE membership can be cancelled at any time and without reason. At the termination, the user name and the THANKYOO registered e-mail address of the user are to be indicated.The Life and Worklife membership can be cancelled without giving reasons within a period of fourteen working days of the expiry of the booked minimum period of use or subsequently at the end of an extension period.After the termination of the LIFE or WORK-LIFE membership by the user, the user keeps free membership up until to its termination. The above rules allows for the right of both parties, to cancel for important reasons. An important reason for id 'is particularly if the continuation of the contract until the expiration of the statutory period of notice for id', taking into account all the circumstances of each case, weighing the interests of id 'and the user as not reasonable. Important reasons include the following events: Non-compliance by the user, breach of the user against his contractual obligations, the reputation of id 'is characterized by the presence of the user as being significantly impaired. In the following cases an entitlement to repayment of already paid advance fees by the user is excluded: id 'renounces the contract for good reason, the user renounces the contract. This excludes the termination due to an important reason that lies in the area of responsibility of id.
10. Final Provisions
Unless otherwise agreed, the user can communicate all explanations to id in writing to the contact details found in the legal information of Thankyoo or contact via the contact page of Thankyoo. id 'statements can be compared to the user in writing to all contact options that the current contact data that the user has in their profile details.Should individual provisions of these Terms be deemed invalid, this does not affect the validity of the remaining provisions. The ineffective provision is covered by an effective response to their meaning and purpose that comes closest to its possible replacement. On the legal relationship between id 'and the user is exclusively under Austrian law to the exclusion of international reference standards. The provisions of the CISG do not apply.Place of fulfilment is the seat of id. Jurisdiction for all resulting direct disputes between id and users is agreed to be handled by the seat of the id’ locally and factually competent Austrian court.
